Chennai: Madras High Court Saturday upheld a single judge`s order holding a bishop guilty of contempt of court, but said its directive to him "to seek pardon from the source in whose jurisdiction he has faith" was a clear case of punishment.
The First Bench comprising acting Chief Justice Sathish K Agnihotri and Justice K K Sasidharan stated this allowing a contempt appeal by Rt Reverend Dr H A Martin, Bishop of Tamil Evanegelical Lutheran Church, Tiruchirapalli, against the single judge`s order, holding him liable for his contemptuous act and directing him "to take pardon from divine faith."

It said the contempt appeal is directed against the September 6 2013 order of a single judge holding Martin guilty of contempt but which refrained from imposing punishment. Its direction permitting him to "seek pardon from the source in whose jurisdiction the contemnor has faith" is a clear case of punishment, the bench said.
The bench while deciding on the moot question whether the order holding Martin guilty of contempt of court and punish him for his contemptuous act and thereafter issue him the directive, said the single judge`s order enables him to file a statutory appeal under the Contempt of Courts Act and said the appeal under the act is maintainable.

(செப்டம்பர் 2010): பெரம்பூரில் உள்ள TELCக்கு சொந்தமான ஒரு சொத்து ரூ40 லட்சத்திற்கு விற்கப்பட்டது, ஆனால், பதிவாளர் அலுவகத்தில் ரூ.68 என்று காண்பிக்கப்பட்டது[2]. 2010களில் ஒரு மனையின் மதிப்பு ரூ. 1 கோடி என்றுள்ளது. ஆனால், இம்மனையின் அளவு 3300 sq.ft[3]. ஆகும், எனவே, நிச்சயமாக குறைந்த அளவில் விற்கப்பட்டுள்ளது என்று தெரிகிறது.  இந்த விசயத்தில் தான் மார்டின் (பிஷப்) மற்றும் சார்லஸ் (செயலாளர்) இவர்களுக்குள் பிரச்சினை ஏற்பட்டது தெரிகிறது. நிருபர்களிடம் மார்ட்டின் கூறியதாவது:  “சபைக்கு சொந்தமான  4  கோடி  ரூபாய்  மதிப்புள்ள நிலத்தை வெறும் 40 லட்சம் ரூபாய்க்கு  விற்றுள்ளனர்.  இதற்கு  சபையின் ஆலோசனைக்குழு  அனுமதி  அளித்திருந்தாலும்,  விற்பனையில் மோசடி  நடந்துள்ளது. சபைக்கு சொந்தமான பள்ளிகளில் தங்களுக்கு பிடித்தவர்களுக்கு  பதவி  உயர்வு,  இடமாறுதல் ஆகியவையும்,  பிடிக்காதவர்களை  பழிவாங்கும்  நோக்கிலும், குருமார்களை  மரியாதை  குறைவாக  நடத்தியும்  வருகின்றனர். எனவே,  நிர்வாகக்குழுவை கலைத்து  விட்டேன். சபையின் அலுவலகத்தையும்  பூட்டி விடுமுறை  விட்டு விட்டேன். ஏற்கனவே  நிர்வாகக்குழு, பல  இடங்களை  மோசடியாக விற்றுள்ளதாக  புகார்  உள்ளது. எனக்கு  ஆபத்து  ஏற்படும் என்பதால்  கலெக்டரிடமும்,  போலீஸிலும்  புகார்  செய்துள்ளேன்”, இவ்வாறு அவர் கூறினார். இதுமாதிரியான பரஸ்பர குற்றச்சாட்டுகள் உள்ளன. திரு ஜே. கனகராஜ் (ஓய்வு) நீதிபதி நிர்வாகியாக நியமிக்கப்பட்டதாக தீர்ப்பில் சொல்லப்பட்டது[4].
